identify raptor?

Hi everyone, came home today to find this Beautiful raptor sitting in the dead tree over the road
:)
any ideas on what sort?
A Whistling Kite?
Falcon?

Stingray the Brown Falcon is the one I am tending to lean towards altough the yellow around the eye throws me, the markings and colour are right.

yepp its the yellow that's got me stumped..
i even went to the Oracle "google" and no matter what name i tried.. no image seemed close enough or if they looked similar they didn't have the yellow

In Mackay mate.....I see heaps of Brown falcons and some Black falcons and I know where they hang out, thats why I asked.

It is definitely a Brown Falcon.
